License to Wed

Sure you need a hall, a photographer and some fancy duds… but don’t forget the most important must-have item for your wedding—your marriage license! Here’s what you need to know to get the legalities in order for your big day.

If you’re getting married in MA, both parties must apply for the license together and in person—whether or not you are a resident.

Applications are made by both parties (in person) in any city or town in MA. Where you apply is where the marriage certificate will be filed.

There is a waiting period of three days. This includes Sundays and holidays, but not the day upon which the application is submitted.

The license is valid for 60 days from the date you file and can be used in any city or town in MA.

There is a state fee of $4.00 for the license, but each town is allowed to set their own fee in addition to that. Check with your town clerk’s office for cost information.

Applicants must be 18 years of age or older. Some towns may require proof, such as a birth certificate.

Please note: The requirements and information listed here are subject to change and may differ for same-sex couples. For the most up-to-date information, contact your clerk’s office directly. To find a town/city clerk's office, go to the Official Web Site of the Commonwealth of Massachusetts.

Information for same-sex weddings in MA can be found on the marriage page of the GLAD organization's Web site, or the Massachusetts Trial Court Law Libraries on their About Same-Sex Marriage page.

If you’re marrying out of state (or having a destination wedding), be sure to check out the requirements for that area. Because those requirements will differ per location, it’s best to take care of this early in your planning.
